Autorizacion de regreso: travelling on an expired card

You filed the renewal on time, the office has your file, and the card in your pocket now reads as expired. Then a reason to leave the country turns up: a funeral, a contract signature, a flight booked six months ago. The question is never whether you can leave Spain. It is whether you will be let back in.

That single question is the entire job of the autorización de regreso. It is a short-lived travel document that authorises your return while the card proving your right to be here is either being renewed or gone. It sits in article 5 of Real Decreto 1155/2024, the Reglamento de Extranjería in force since 20 May 2025, and the Policía Nacional files it under procedure code 994614.

An expired card is a border problem, not a residence problem

Filing your renewal inside the legal window extends your previous authorisation until the file is resolved (article 80.1). You are lawfully in Spain the whole time you wait. That protection covers your status. It does not cover your card.

A border officer reads the card. Plastic whose expiry date has passed documents nothing, whatever the state of your file back in the province. The autorización de regreso fills that one gap and nothing wider: it authorises a return, it does not extend your permit, and it does not stand in for the card you are waiting for. Nothing is happening to the number underneath, which never expires anyway, the point made in renewing your NIE.

It covers exactly two situations, and no others

Article 5.1 is narrow, and that narrowness is the first thing to establish before you spend anything.

  • Your residence or stay authorisation is in renewal or in prórroga, and you can prove that you filed the application within the legal period.
  • You hold a valid TIE that has been stolen, lost, destroyed or rendered unusable, and you can prove you have applied for a duplicado.

There is no third case. If your authorisation was refused, if you never filed, if you are in Spain on a short stay with nothing behind it, this is not your document and no counter will turn it into one. The word carrying the weight in both situations is prove: what you hand over is evidence that an open file exists.

Which makes the filing window part of the story. Under article 80.1 the renewal goes in during the two months before the card expires, and it is still admissible in the three months following expiry, though filing late can be sanctioned. Any guide still quoting Real Decreto 557/2011 is quoting a text repealed on 20 May 2025.

If the card was stolen and you also cannot lay hands on the number itself, that is a separate problem with its own route, set out in finding your NIE number.

Ninety days, and the trap in when they start

The authorisation runs for ninety days. What almost nothing published on this says out loud is that the start date depends on when you applied, and that decides how much of the window you actually get to use (article 5.2).

  • Applied before your authorisation expires: the ninety days run from the expiry date of that authorisation.
  • Applied once it has already expired: the ninety days run from the date the autorización de regreso is granted.

Applying early is therefore not a neutral piece of good behaviour. It moves your window. Go in two weeks before expiry and you have not bought an extra fortnight, because the clock still starts on the date printed on the card. Go in three weeks late and it starts on the day of the grant, pushing the far end later. Neither is better in the abstract. What matters is that the ninety days sit over both dates on your ticket.

Article 5.2 also provides for preferential processing where the trip answers a genuine necessity. Say so at the counter, with the reason and the paper backing it. Urgency is not legible from the file.

Unlimited entries and exits, through Spanish border posts only

Two provisions pull in opposite directions, and both change how you book.

  • Article 5.5: unlimited entries and exits. During the ninety days that single document covers as many trips as you make. It is not a one-way pass, and you do not apply again for the second journey.
  • Article 5.6: authorised Spanish border crossing points only. The document authorises your return through Spanish puestos fronterizos habilitados. It is not a general Schengen re-entry document.

The second is a real constraint on itineraries, and invisible while you compare fares. A cheaper return landing in Paris or Amsterdam and continuing overland means the border post where you present yourself is not a Spanish one. A direct flight into a Spanish airport is the shape of trip this document was written for.

The form, the fee, and the 012 versus 052 question

The application is the modelo EX-13. The fee is 10,72 euros, heading 5.10 of Orden PJC/617/2025, the order that re-set every extranjería tasa on 16 June 2025.

The part that confuses people is the payment slip, and the rule is simpler than the forums make it. The tasa is paid on a modelo 790, and the código, 012 or 052, follows which body resolves your file, not which procedure you are filing. Resolved by the police: 012. Resolved by the Oficina de Extranjería: 052. The amount is identical either way, so the wrong código is not a wrong amount, it is a payment routed to the wrong body. Budget it separately from the renewal you are waiting on. Renewing a TIE for temporary residence or prórroga carries its own tasa of 19,30 euros, which this neither includes nor replaces. Two procedures, two fees, as in what an NIE number costs.

What to bring, and why you have to turn up in person

The Policía Nacional page for this procedure lists two items: the completed EX-13 and proof that the tasa has been paid. That list is shorter than what you should walk in holding.

  • The EX-13, completed in Spanish.
  • The validated proof of payment of the 10,72 euro tasa. A generated slip you never paid proves nothing.
  • Your passport, valid, with a copy. Not on the published list, and you will not get far without it.
  • Evidence of the file that entitles you to apply: the receipt for the renewal or prórroga application, or for the duplicado after a theft or loss.

The last item is the substance of the request: article 5.1 conditions the authorisation on proving that file exists, so it is the one thing you cannot improvise on the morning.

It is filed in person. The police page states that there is no online channel for this procedure. Spanish electronic identification opens a great deal of the administration, and what a digital certificate and Cl@ve are explains how to get it, but it does not open this door.

When you do not need it at all

This is where money and appointments get wasted, so it is worth being blunt. If your TIE is valid and unexpired, you do not need an autorización de regreso. Article 6.3 is explicit that the holder of a valid card needs no visa to come back. A valid TIE plus a valid passport is the complete set.

  • Your card is in date and no renewal is open: there is nothing to apply for. You travel on the card and the passport.
  • You are an EU, EEA or Swiss citizen: there is no TIE in your situation to begin with. The registration certificate is a different object with a different procedure, set out in the modelo EX-18.
  • You hold only an NIE with no residence authorisation behind it: nothing is in renewal, so article 5.1 does not reach your case. What residence does and does not mean is untangled in everything you need to know about residency.

The recurring mistake is spending 10,72 euros and an in-person slot to protect a card that was never at risk. Read the expiry date on the card in your hand before anything else, this article included.

What is not documented, and we are not going to guess

Three questions get asked constantly and answered with great confidence on no visible source.

  • How long it takes to be issued. Article 5 sets no processing deadline. None. Nobody can quote you a legal maximum, because there is not one.
  • Whether you get it the same day. Immediate issuance at the comisaría is widely reported, and we have found no official documentation of it. Treat it as what applicants describe, not as something you are entitled to.
  • Whether you need a cita previa, and under which heading. The police page states no appointment requirement and names no category. Since booking the wrong category is the standard way to lose a slot, ask the office handling your file rather than guessing from a dropdown.

Plan around the uncertainty rather than around a figure from a blog. A close flight and an open file is an argument for walking into the office early, not for trusting a processing time nobody publishes.

The order to do this in

Sequence prevents the wasted trip. Most failures happen before the counter.

  • Read the expiry date on your card. If it has not passed and nothing is in renewal, stop here.
  • Confirm which of the two situations in article 5.1 you are in, and locate the receipt that proves it.
  • Ask whether the police or the Oficina de Extranjería is resolving your file, because that decides 012 or 052.
  • Generate and pay the tasa, 10,72 euros, and keep the validated proof.
  • File the EX-13 in person, with the passport and the receipt.
  • Count the ninety days from the correct start date and check they cover departure and return.
  • Book a return that puts you at a Spanish authorised border crossing point.
